These Terms of Service ("Terms") are a legal agreement between you and Klyyr LLC ("Klyyr," "we," "us," or "our") governing your access to and use of klyyr.com, our online store, customer accounts, subscriptions, communications, content, and products (collectively, the "Services"). By accessing the Services, placing an order, or starting a subscription, you agree to these Terms.

Eligibility

You must be at least the age of majority in your jurisdiction, or use the Services with involvement of a parent or legal guardian who agrees to these Terms. You may not use the Services if doing so would violate applicable law.

Product information and oral care disclaimer

Our products and content are provided for general oral care and informational purposes. They are not medical or dental advice, diagnosis, or treatment, and they are not a substitute for care from a dentist, physician, or other licensed professional. Statements about oral care ingredients or product benefits have not necessarily been evaluated by the U.S. Food and Drug Administration. Products are not intended to diagnose, treat, cure, or prevent any disease.

Use products only as directed. Stop use and contact a professional if irritation, allergic reaction, or other concern occurs. Keep products out of reach of children except under appropriate adult supervision. Ingredient lists, packaging, availability, and product descriptions may change; always review the product packaging you receive.

Orders

Placing an order is an offer to purchase. We may accept, refuse, cancel, or limit any order for reasons including suspected fraud, resale activity, payment issues, inventory limits, shipping restrictions, pricing errors, product errors, or violation of these Terms. If we cancel an order after payment, we will issue any refund required by law.

Prices and payment

Prices, promotions, shipping charges, taxes, and availability may change without notice before an order is placed. You agree to provide current, complete, and accurate billing and account information. By submitting payment information, you represent that you are authorized to use that payment method and authorize us and our payment processors to charge it for your order, subscription, taxes, shipping, and any other amounts shown at checkout.

Shipping, returns, and subscriptions

Our Shipping Policy, Returns and Refunds Policy, and Subscription Terms are incorporated into these Terms. If there is a conflict, the more specific policy controls for that subject unless these Terms expressly say otherwise.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised. We may suspend or terminate accounts that violate these Terms, create risk, or are used for fraudulent, abusive, or unlawful activity.

Intellectual property

The Services, including text, graphics, photographs, videos, logos, product names, packaging, design, code, and other content, are owned by Klyyr or our licensors and are protected by intellectual property laws. You may use the Services for personal, non-commercial shopping purposes only. You may not copy, reproduce, modify, distribute, scrape, sell, or exploit the Services or our content without written permission.

User content and reviews

If you submit reviews, comments, photos, feedback, testimonials, ideas, or other content, you grant Klyyr a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, edit, publish, translate, distribute, display, and create derivative works from that content in connection with our business, including marketing. You represent that you own or have permission to submit the content and that it does not violate any law or third-party right. We may remove or refuse user content at our discretion.

Prohibited uses

You may not use the Services to violate law, infringe rights, transmit harmful code, interfere with security, scrape or harvest data, impersonate others, submit false information, abuse promotions or returns, resell products without authorization, or engage in conduct that harms Klyyr, our customers, our partners, or the Services.

Third-party services and links

The Services may rely on or link to third-party platforms, including Shopify, payment processors, shipping carriers, email and SMS providers, analytics providers, and social platforms. We are not responsible for third-party services, websites, policies, content, or practices. Your use of third-party services may be governed by their terms and privacy policies.

Warranty disclaimer

Except for any express warranty we provide in writing and any rights that cannot be limited by law, the Services and products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and uninterrupted operation.

Limitation of liability

To the fullest extent permitted by law, Klyyr and our owners, employees, contractors, suppliers, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, or business, arising out of or related to the Services or products. To the fullest extent permitted by law, our total liability for any claim will not exceed the greater of the amount you paid to Klyyr for the product or service giving rise to the claim or $100.

Indemnification

You agree to defend, indemnify, and hold harmless Klyyr and our owners, employees, contractors, suppliers, service providers, and affiliates from and against claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, misuse of the Services, violation of law, or infringement of rights.

Disputes, arbitration, and class waiver

Please contact us first at hi@klyyr.com so we can try to resolve any concern informally. If we cannot resolve a dispute informally, you and Klyyr agree that, to the fullest extent permitted by law, disputes will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court or seek injunctive relief for intellectual property misuse or unauthorized access.

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules, unless another forum is required by law or agreed in writing. You and Klyyr waive the right to a jury trial and the right to participate in a class action, class arbitration, private attorney general action, or other representative proceeding to the fullest extent permitted by law. You may opt out of this arbitration agreement by emailing hi@klyyr.com within 30 days after first accepting these Terms and stating your name, order email, and intent to opt out of arbitration.

Governing law

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-law rules, except to the extent federal law or mandatory consumer protection law requires otherwise.

Changes to the Services or Terms

We may update the Services and these Terms from time to time. Updated Terms are effective when posted unless a later date is stated. Your continued use of the Services after changes are posted means you accept the updated Terms. If you do not agree, stop using the Services and cancel any subscription before the next renewal.

Severability

If any part of these Terms is found unenforceable, that part will be limited or severed to the minimum extent necessary, and the remaining terms will remain in effect.
