1. Who We Are and What This Policy Covers

KLYYR [REPLACE WITH LEGAL ENTITY NAME, e.g., "Klyyr LLC"] ("KLYYR," "we," "us," or "our") operates the website klyyr.com and the related online store, including all related information, content, features, tools, products, and services (collectively, the "Services"). Our store is hosted by Shopify.

This Privacy Policy describes how we collect, use, and disclose your personal information when you visit or use the Services, make a purchase or other transaction, interact with our advertisements or social media pages, or otherwise communicate with us. For residents of the European Economic Area ("EEA"), the United Kingdom, and Switzerland, KLYYR is the data controller of your personal information unless otherwise stated (see Section 13).

If there is a conflict between our Terms of Service and this Privacy Policy, this Privacy Policy controls with respect to the collection, processing, and disclosure of your personal information.

Please read this Privacy Policy carefully. By using or accessing the Services, you acknowledge that you have read this Privacy Policy and understand the collection, use, and disclosure of your information as described here.

2. Personal Information We Collect

When we use the term "personal information," we mean information that identifies, relates to, describes, or can reasonably be linked to you. It does not include information that is anonymous, aggregated, or de-identified such that it cannot reasonably be linked to you.

2.1 Information You Provide to Us

  • Contact details, including your name, billing address, shipping address, phone number, and email address.
  • Order and transaction information, including the items you view, add to your cart or wishlist, purchase, return, exchange, or cancel, and your order history.
  • Payment information, including form of payment and payment confirmation. Payment card details are collected and processed directly by our payment processors (such as Shopify Payments, Shop Pay, or PayPal). We do not receive or store your full payment card number.
  • Account information, including your username, password, security questions, preferences, and settings.
  • Communications, including information you provide when you contact customer support, respond to surveys, leave a product review, or otherwise communicate with us.
  • Marketing preferences, including your email or SMS sign-up status and communication choices.

2.2 Information We Collect Automatically

When you use the Services, we and our third-party providers automatically collect certain information about your device and how you interact with the Services ("Usage Data") using cookies, pixels, and similar technologies (described in detail in Section 4):

  • Device and connection information, such as device type, operating system, browser type and version, screen resolution, language settings, IP address, and approximate geographic location derived from your IP address (city/region level — we do not collect precise geolocation).
  • Identifiers, such as cookie IDs, session IDs, and advertising click identifiers (for example, the TikTok click ID "ttclid" appended to links from TikTok ads).
  • Usage information, such as the pages and products you view, searches you run, items you add to your cart, how you arrived at our site (referring URLs and ad campaigns), the dates and times of your visits, and how you navigate and interact with the Services.

2.3 Information We Collect from Third Parties

  • Shopify and other service providers that enable technology for us or collect or process personal information on our behalf.
  • Payment processors and fraud-prevention providers, such as payment confirmations and fraud-screening signals.
  • Advertising and analytics partners (such as Google and TikTok), including information about your interactions with our advertisements and campaign performance data.
  • Shipping and fulfillment partners, such as delivery status information.
  • Social media platforms, if you interact with our pages, posts, or ads on those platforms, subject to your settings on those platforms.

2.4 Inferences

We may draw inferences from the information described above — for example, about your product preferences — to personalize your shopping experience and our marketing.

2.5 Sensitive Personal Information

We do not seek to collect sensitive personal information (such as government identification numbers, precise geolocation, health information, or biometric data), and we ask that you not provide it to us. The only category of information we collect that may be considered "sensitive" under certain laws is your account log-in credentials (username and password), which we use solely to maintain and secure your account and do not use to infer characteristics about you.

3. How We Use Your Personal Information

Depending on how you interact with us, we use personal information for the following purposes:

  • Providing the Services. To perform our contract with you: process your payments and orders; arrange shipping, returns, and exchanges; create and manage your account; remember your preferences and cart; enable product reviews; send transactional notifications (such as order and shipping confirmations); and provide customer support.
  • Personalization and improvement. To tailor the Services to you (such as recommending products), understand how visitors use the Services, measure site performance, diagnose errors, and develop and improve our products, Services, and marketing.
  • Marketing and advertising. To send marketing communications by email, text message, or postal mail (where you have opted in or where otherwise permitted by law); to show you advertisements for our products on other websites, apps, and platforms (including TikTok), including ads based on products you viewed, added to your cart, or purchased; to build advertising audiences; and to measure the effectiveness of our advertising campaigns.
  • Security and fraud prevention. To authenticate your account, provide a secure checkout, and detect, investigate, and prevent fraudulent, illegal, unsafe, or malicious activity. If you create an account, you are responsible for keeping your credentials safe; do not share your username or password with anyone.
  • Legal compliance. To comply with applicable law and valid legal process; respond to law enforcement or government requests; investigate or participate in litigation or other legal proceedings; enforce our terms and policies; and establish, exercise, or defend legal claims.

4. Cookies, Pixels, and Similar Technologies

We use cookies (small text files stored on your device), pixels/web beacons, local storage, tags, and similar technologies (collectively, "cookies") to operate the Services, analyze usage, and support our advertising. Some are set by us ("first-party") and some are set by the third parties described below ("third-party").

4.1 Categories of Cookies We Use

  • Strictly necessary. Required to operate the store — for example, keeping items in your cart, enabling checkout, remembering your session, and providing security. These cannot be disabled through our preference tools.
  • Analytics and performance. Help us understand how visitors find and use our store, so we can improve it.
  • Advertising and targeting. Used to show you relevant ads for our products on other platforms, limit how often you see an ad, and measure ad performance.
  • Functional. Remember choices you make (such as region or language) to provide a more personalized experience.

Google Analytics. We use Google Analytics to help us understand how customers use the Services. To learn how Google collects and processes data, visit https://policies.google.com/technologies/partner-sites. You can opt out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

TikTok. When you visit our store, the TikTok Pixel (and, where enabled, server-side events sent through the TikTok Events API) transmits information to TikTok about your device, browser, IP address, and actions on our site (such as pages viewed, products viewed, add-to-cart events, and purchases, including order value). Where advanced matching is enabled, this may include contact information you provide at checkout (such as your email address or phone number) in hashed (pseudonymized) form, used by TikTok to match events to TikTok accounts for measurement and ad targeting. TikTok processes this information in accordance with its own privacy policy and may use it for its own purposes as an independent controller.

4.3 Your Cookie and Advertising Choices

  • Cookie preferences. Where a cookie consent banner is shown, you can accept, decline, or customize non-essential cookies, and change your choices at any time via the cookie preferences link on our site.   • Opt out of "sale"/"sharing"/targeted advertising. Use the "Do Not Sell or Share My Personal Information" / "Your Privacy Choices" link in our website footer, or the methods in Section 10.
  • Global Privacy Control (GPC). If you browse with a legally recognized opt-out preference signal such as Global Privacy Control enabled, we treat it as a request to opt out of the sale/sharing of personal information for that browser and device (and, where we can associate the signal with an account, for the account as well). Other than GPC, we do not respond to "Do Not Track" browser signals, for which no standard has been adopted.
  • Browser controls. Most browsers let you block or delete cookies through their settings. Blocking strictly necessary cookies may break core store functions such as cart and checkout.
  • Industry opt-outs. You can opt out of interest-based advertising from participating companies at optout.aboutads.info (Digital Advertising Alliance), optout.networkadvertising.org (Network Advertising Initiative), and, for the EU, youronlinechoices.eu.
  • Platform controls. You can manage ad personalization in your Google Ads Settings and in TikTok under Settings → Ads (or equivalent) in the TikTok app.
  • Mobile devices. iOS and Android offer device-level settings to limit ad tracking or reset your advertising identifier.

Opting out of interest-based advertising does not mean you will stop seeing ads — only that the ads you see will be less relevant to you.

5. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients for the purposes described in this Privacy Policy:

  • Shopify and other service providers that perform services on our behalf, such as store hosting, IT and infrastructure, payment processing, order fulfillment and shipping, customer support, email and SMS delivery, data analytics, cloud storage, and fraud prevention. These providers are permitted to use personal information only to provide services to us.
  • Advertising and analytics partners, including Google (Google Analytics 4, Google Tag Manager) and TikTok (TikTok Pixel / Events API), as described in Section 4. These partners may use the information they collect for their own purposes in accordance with their own privacy policies, and this disclosure may be considered a "sale" or "sharing" of personal information, or "targeted advertising," under certain state privacy laws. You can opt out as described in Sections 4.3 and 10. We do not disclose personal information to any third party in exchange for money.
  • Payment processors and financial institutions, to process your payments and prevent fraud.
  • Recipients you direct or consent to, such as shipping carriers delivering your order, or when you use social media widgets or login integrations.
  • Affiliates and other entities within our corporate group, if any, consistent with this Privacy Policy.
  • Parties to a corporate transaction, such as a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which personal information may be disclosed or transferred as part of the transaction.
  • Legal and safety recipients, where we believe disclosure is required or appropriate to comply with law or legal process (including subpoenas, search warrants, and similar requests), respond to law enforcement or government agencies, enforce our terms and policies, or protect the rights, property, or safety of KLYYR, our customers, or others.

6. Our Relationship with Shopify

The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services is transmitted to and shared with Shopify and with third parties that may be located in countries other than where you reside.

In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data obtained from your interactions with our store, with other merchants, and with Shopify. For these enhanced features, Shopify is responsible for the processing of your personal information, including responding to requests to exercise your rights over that processing. Depending on where you live, you may exercise certain rights with respect to personal information processed by Shopify through the Shopify Privacy Portal.

7. Third-Party Websites and Links

The Services may contain links to websites or platforms operated by third parties, including TikTok and other social media platforms. We do not control, and are not responsible for, the privacy or security practices of those third parties, or the accuracy or reliability of information on their sites. If you follow a link to a third-party site, review its privacy policy and terms. Information you share on public or semi-public venues — including third-party social platforms — may be viewable by others without limitation as to its use. Our inclusion of a link does not imply endorsement of the linked platform.

8. Marketing Communications

Email. If you sign up for our emails, we will send you marketing and promotional messages. You can opt out at any time using the "unsubscribe" link in any marketing email. If you opt out, we may still send you non-promotional messages, such as order confirmations, shipping updates, and account notices.

9. Children's Privacy

The Services are not intended for children, and we do not knowingly collect personal information from children under the age of 13 (or the age of majority in your jurisdiction, if higher). If you are a parent or guardian and believe your child has provided us with personal information, contact us using the details in Section 17 and we will delete it as required by law. We do not have actual knowledge that we "sell" or "share" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.

10. Your Privacy Rights and Choices

Depending on where you live, you may have some or all of the following rights with respect to your personal information. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline your request as permitted by law.

  • Right to know / access. Request access to, and information about, the personal information we hold about you, including the categories collected, the sources, the purposes, and the categories of third parties to whom it is disclosed.
  • Right to delete. Request that we delete personal information we maintain about you.
  • Right to correct. Request that we correct inaccurate personal information we maintain about you.
  • Right to portability. Receive a copy of your personal information in a portable format and, where feasible, have it transmitted to another party.
  • Right to opt out of "sale," "sharing," and targeted advertising. Opt out of the disclosure of your personal information for cross-context behavioral / targeted advertising, and of any "sale" of personal information as defined by applicable law.
  • Right to limit use of sensitive personal information. We do not use or disclose sensitive personal information for purposes that would trigger a right to limit under applicable law.
  • Right to withdraw consent. Where processing is based on consent, withdraw that consent at any time (without affecting processing that occurred before withdrawal).
  • Right to non-discrimination. We will not discriminate against you for exercising any of these rights — for example, by denying services or charging different prices — except as permitted by law (such as a permissible loyalty program).

Verification. We may need to verify your identity before processing your request, as permitted or required by law — for example, by asking you to confirm information associated with your account or orders. Opt-out requests do not require verification, but we may ask for information needed to locate your records.

Authorized agents. Where permitted by law, you may designate an authorized agent to submit requests on your behalf. We will require proof that you authorized the agent, and we may need to verify your identity directly.

Timing. We will respond to your request within the time required by applicable law.

Appeals. If we decline to take action on your request, you may appeal by replying to our decision or emailing ben@klyyr.com with the subject line "Privacy Appeal." If your appeal is denied, you may contact your state Attorney General or, where applicable, your local data protection authority.

11. Additional Disclosures for U.S. State Residents

This section applies to residents of California and other U.S. states with comprehensive privacy laws (including, for example, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and Montana), and supplements the rest of this Privacy Policy.

We collect these categories from the sources described in Section 2, for the purposes described in Section 3, and we retain them as described in Section 12. We do not use or disclose sensitive personal information to infer characteristics about you or for purposes other than those permitted under applicable law. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Opting out. California residents (and residents of other states with similar rights) may opt out of the "sale" or "sharing" of personal information, or its processing for targeted advertising, using any of the methods in Section 10, including the "Do Not Sell or Share My Personal Information" link in our footer and the Global Privacy Control signal.

We may offer discounts or promotions (for example, a percentage off your first order) in exchange for signing up for our email or SMS list. We will not use the personal information collected in ways that are materially inconsistent with this Privacy Policy.

California "Shine the Light." California residents may request information about our disclosure of personal information to third parties for their own direct marketing purposes. To make such a request, contact us using the details in Section 17.

Nevada residents. We do not currently sell covered information as defined by Nevada law. Nevada residents may nonetheless submit a request to opt out of any future sale by contacting us.

12. Security and Retention

We use administrative, technical, and physical safeguards designed to protect personal information, including transport-layer encryption (TLS/HTTPS) on our storefront and checkout. However, no security measures are perfect or impenetrable, and we cannot guarantee "perfect security." Any information you send to us may not be secure while in transit; we recommend that you not use unsecured channels to send us sensitive or confidential information.

We retain personal information only as long as needed for the purposes described in this Privacy Policy, unless a longer period is required or permitted by law. Retention periods depend on factors such as: whether we need the information to maintain your account or provide the Services; whether it is needed to comply with legal obligations (such as tax and accounting record-keeping, which may require retaining order records for up to seven years or the period required in your jurisdiction); whether it is needed to resolve disputes, prevent fraud, or enforce our agreements; and whether you have asked us to delete it. Marketing suppression records (such as unsubscribe requests) are kept as needed to honor your preferences. Analytics data is retained in accordance with the retention settings of our analytics providers.

Your rights. In addition to the rights in Section 10, you have the right to object to processing based on legitimate interests (including direct marketing), the right to restrict processing in certain circumstances, and the right to lodge a complaint with your local supervisory authority (though we would appreciate the chance to address your concerns first — see Section 17).

International transfers. We are based in the United States, and your personal information will be transferred to, stored, and processed in the United States and other countries that may not provide the same level of data protection as your home jurisdiction. Where we transfer personal information out of the EEA, the UK, or Switzerland, we rely on recognized transfer mechanisms such as the European Commission's Standard Contractual Clauses (or the UK and Swiss equivalents), adequacy decisions, or recipients' certification under the EU-U.S. Data Privacy Framework and its UK and Swiss extensions, as applicable.

14. Additional Information for Canada

If you are in Canada, we collect, use, and disclose your personal information with your consent (express or implied, as permitted by law) or as otherwise permitted or required by applicable law, and your information may be processed and stored outside Canada (including in the United States), where it may be accessible to local authorities under local law. You may request access to or correction of your personal information, or withdraw consent (subject to legal and contractual restrictions), by contacting us. You may also contact the Office of the Privacy Commissioner of Canada with concerns.

15. Complaints

If you have a complaint about how we process your personal information, please contact us using the details in Section 17. Depending on where you live, you may also have the right to appeal our decision (see Section 10) or to lodge a complaint with your state Attorney General or local data protection authority.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for operational, legal, or regulatory reasons. We will post the revised policy on this page, update the "Last Updated" date, and, for material changes, provide additional notice as required by applicable law (such as a notice on our homepage or by email). Your continued use of the Services after the effective date of a revised policy constitutes your acknowledgment of the revised policy to the extent permitted by law.
